Konføderation/konføderalisme
Centralt: Konføderation er et ‘statsforbund’ i modsætning til en føderation, som er en ‘forbundsstat’. Konføderation er en løs sammenslutning af uafhængige stater, dog tættere end en alliance, fordi der etableres visse fælles politiske institutioner.

– Man kan argumentere for, at EU samarbejdet i dag er et konføderalt samarbejde. Men det er et meget udbygget samarbejde, som er særdeles unikt i sin konstruktion med fælles traktater, institutioner og lovgivning. Men det er vigtigt at bemærke, at det ikke er EU-Parlamentet der lovgiver for samarbejdet. Den besluttende institution ligger i Ministerrådet, som træffer EU’s beslutninger. Beslutninger som så efterfølgende skal følges op i de enkelte landes nationale lovgivning.

Den lovgivende magt: Den lovgivende magt ligger hos et parlamentet med to kamre → bestående af nationalforsamlingen og senatet.

Den udøvende magt: Den udøvende magt ligger hos præsidenten(vælges for 5 år), der har en række magtfulde beføjelser; Han udnævner premierministeren og på dennes forslag regeringens øvrige medlemmer, og han leder regeringsmøderne. Præsidenten kan udskrive folkeafstemninger, opløse nationalforsamlingen og udskrive valg.

Det er altså Frankrigs præsident, der udpeger premierministeren, som har til opgave at danne en regering. I praksis er det dog noget, som præsidenten gør i samarbejde med premierministeren – medmindre de to er fra hver deres politiske blok.Præsidenten skal desuden godkende ministrene

De første kom allerede i 1791 og kaldes samlet for Loven om Rettigheder, Bill of Rights. Den garanterer ytringsfrihed, pressefrihed, religionsfrihed, forsamlingsfrihed, sikrer borgeren mod vilkårlige husundersøgelser og giver ham eller hende ret til at få sin sag prøvet ved en domstol.

USA’s grundlov bygger på principperne om magtdeling. Tanken er, at den udøvende, den lovgivende og den dømmende magt skal være adskilte og afbalancere hinanden.
Den lovgivende magt: Den lovgivende magt tilhører Kongressen, som består af to kamre. Det ene kammer, Repræsentanternes Hus, består af 435 medlemmer, som vælges ved direkte valg i de enkelte stater gældende for en periode på 2 år.

Det andet kammer, Senatet, har 100 medlemmer, 2 fra hver stat, som vælges ved direkte valg i en periode på 6 år, hvoraf 1/3 af medlemmerne udskiftes hvert andet år.

Lovforslag kan fremsættes af begge kamre og skal for at blive bindende vedtaget samle flertal i nøjagtig samme form i både Senatet og Repræsentanternes Hus. Dog besidder præsidenten retten til at nedlægge veto og kan dermed blokere et eventuelt lovforslag. I sådan et tilfælde vil en 2/3 majoritet i begge kamre være nødvendig for at tilsidesætte præsidentens veto.

Den udøvende magt: Den udøvende magt ligger hos præsidenten og dennes regering → kaldes kabinettet.

USA er ikke et parlamentarisk demokrati. Præsidenten er således ikke afhængig af støtte fra Kongressen for at kunne udøve sin magt. Det er ikke usædvanligt, at præsidenten og kongresflertallet repræsenterer to forskellige partier.
Checks and balances: De tre statsmagter(den lovgivende, udøvende og dømmende) kontrollerer hinanden, for at undgå at magten bliver centreret. For at den udøvende magt, præsidenten og regeringen, kan få gennemført sine lovforslag, skal der fx være flertal for lovforslaget i senatet, den lovgivende magt. Til gengæld kan præsidenten nedlægge veto mod nye love, dog kan hans vetoret nedlægges hvis der er 2/3 flertal for det i senatet. Derved kontrollerer den lovgivende og udøvende magt hinanden.

Regionalisme Tyskland er opdelt i 16 stater (länder), hvor mange af dem har deres egen historie og sociale struktur. Sprog og dialekt differentiere også.
De regionale overvejelser er en vigtig faktor i samfundet og i politik.

Den decentraliserede natur i samfundet og i økonomien forstærker ligeledes de regionale forskelligheder.

For at kunne forstå det politiske Tyskland, er det vigtigt at sætte sig ind i de problemer/behov hver region har, da de viser forskellige politiske og sociale interesser.
Tysklands institutioner og regeringsstruktur Den politiske magt er delt mellem den føderale regering og de regionernes regeringer.

Den føderale regering har det primære politiske ansvar i de fleste policy-områder.

Regionerne har dog magten til at bestemme over uddannelsesområdet, kultur, politi og regional planlægning.
På andre områder deles den føderale regering og de regionale regeringer om ansvaret, hvor den føderale lovgivning i sidste ende må bestemme.

Tyskland regionale regeringer har en et-kammer legislature, som bliver direkte valgt ved en folkeafstemning. Det Parti eller den koalition der kontrollere the legislature vælger en ministerpræsident. Det føderale system tillader partikoalitioner der kan variere meget fra stat til stat.

De regionale regeringer er primært ansvarlige for policy-adminstration, som håndhæver det meste af den nationale lovgivning, lavet af den føderale regering samt de regionale love.

De regionale regeringer har også opsyn med de lokale regeringer.

Tysklands føderale system sørger for at decentralisere magten således at den regionale regerings politiske magt balanceres mod den føderale regerings politiske magt.

Parlamentet fungerer som en check på den udøvende magt, da de to kamre til sammen har meget magt.

den føderale regering fungerer efter tre principper:

The chancellor principle: kanzleren definerer regeringens policies.

Ministerial autonomy: giver hver minister autoriteten til at bestemme over deres interne arbejde uden indblanden fra kabinettet, så længe de følger regeringens guide-lines.
Magtens deling Det er meget vigtig at magten i tyskland ikke centraliseres til en aktør eller en institution grundet deres historie.

Hver institution i regeringen har meget magt i deres eget domæne, men er meget begrænset i at udøve magt over andre institutioner.
